July 24, 2026: Abbott bellwether judgment affirmed

In Mar v. Abbott Laboratories, the Seventh Circuit affirmed summary judgment because the evidence did not show that the proposed alternative warning would have changed the feeding decision and prevented the infant's death. The court expressly did not decide the broader product-causation issue Abbott asked it to reach.

July 28, 2026: five Mead cases returned for further proceedings

The Seventh Circuit reversed the district court's fraudulent-joinder approach in five cases. That decision concerned federal jurisdiction and did not find that either manufacturer's product was defective or caused NEC.

Premature-infant product and manufacturer scope

The litigation focuses on specified cow's-milk-based preterm nutrition products and fortifiers used in NICUs. The record must identify the manufacturer and product actually administered.
